DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA) POLICY

SlingFile.com is an Online Service Provider, under Title II of the Digital Millennium Copyright Act, 17 U.S.C., Section 512 ("DMCA"). SlingFile.com respects the legal Intellectual Property Rights of copyright owners and has implemented an efficient policy and takedown procedure in accordance with the copyright law and the DMCA, and that is described herein. This policy is proposed to lead copyright owners in operating that procedure, and also to lead webmasters in re-establishing access to websites that are disabled due to mistake. Use of this site bounds everyone to respect and adheres the legal security provided by appropriate copyright law.

Notice To Copyright Owners

The DMCA presents a legal procedure by which you can apply to any Online Service Provider to disable access to a website where your copyrighted work(s) is displayed or used without your consent. This legal procedure has two parts: (i) Writing a Proper DMCA Notice, and (ii) Sending the Proper DMCA Notice to SlingFile.com's designated representative.

Writing A Proper DMCA Notice

A Proper DMCA Notice will inform SlingFile.com of detailed facts in a document signed under penalty of perjury. This is what we refer as a "proper DMCA Notice." To write a Proper DMCA Notice, provide the below information:

a) Identify yourself as either:

i. The "copyright owner of the work(s)," or

ii. The "authorized person to take action on behalf of the copyright owner of the legal right that is supposedly infringed."

b) Provide your contact information, (such as, your REAL NAME, street address, telephone number, and email address).

c) Mention the copyrighted work that is supposed to be infringed, or if a lot of work has been infringed then provide a representative list of the works.

d) Point out the material that is considered to be infringing your copyrighted work, and to which you are requesting that SlingFile.com disable access over the Internet.

e) Pinpoint the placement of the material that is infringing your copyrighted work on the Internet by providing "sensibly sufficient information to allow SlingFile.com to locate that material."

f) State that you have "a strong belief that use of the material in the way complained of, is not permitted by the copyright owner, its representative, or the copyright law."

g) State that the "information in the Proper DMCA Notice is correct, under penalty of perjury".

Sign the Proper DMCA Notice with either a physical or electronic signature.

Sending The Proper DMCA Notice To The Designated Representative

To implement your DMCA rights, you should send your Proper DMCA Notice to the following representative designated by SlingFile.com (the "Designated representative") by using the online ticket system.

What SlingFile.com does after receiving a proper DMCA Notice

SlingFile.com will pursue the procedures provided in the DMCA, that described a policy and a takedown procedure, subject to the webmaster's lawful right to submit a Counter-notification claiming lawful use of the disabled work(s).

DMCA Notice and Takedown Procedure

It is believed that all users of any part of the SlingFile.com will obey the appropriate copyright laws. However, if SlingFile.com is informed of claimed copyright infringement, or otherwise becomes aware of facts and circumstances from which infringement is evident, it will promptly take action by removing, or disabling access to, the material that is claimed to be infringing or to be the subject of infringing action. SlingFile.com will comply with the suitable terms of the DMCA in the event a counter notification is received by its designated representative.

Notice to Users of SlingFile.com

In accordance with this Terms of Service you agreed upon at the time of becoming a user of SlingFile.com, you are required to use only lawfully-obtained work(s) such as website content, and your website may be disabled upon receipt of DMCA notice that infringing work(s) is appearing there. SlingFile.com respects the lawful interests of webmasters in using media content lawfully, being permitted to provide a response to claims of infringement, and taking timely restoration of access to a website that has been disabled due to a copyright infringement.

Your use of SlingFile.com privileges will also be suspended. You may submit a Counter-notification to protest a DMCA notice as described below.

Counter-notification

If access to your website is disabled due to copyright infringement by SlingFile.com notice and takedown procedure listed above, and you believe the takedown was inappropriate, you should submit a Counter-notification.

Writing A proper Counter-notification

To write a Proper Counter-notification, you should provide the below information:

a) State that the access to your website was disabled due to operation of the notice and takedown procedure.

b) Identify the work(s) that has been removed and provide its URL prior to removal.

c) State, under penalty of perjury:

i. Your REAL name, full address, email, and telephone number,

ii. That you "have a strong belief that the work(s) was removed due to mistake or misidentification of the work(s),"

iii. That you "have the permission to the jurisdiction of the Federal District Court for the judicial district in which the address is situated."

Submitting a Proper Counter-Notification To Slingfile.com

To implement your DMCA rights, you must submit your Proper Counter-Notification to the "Designated representative" for SlingFile.com by using the online ticket system.

Replicate Infringers

The user who violated the SlingFile.com's DMCA Policy or any other Terms & Conditions of the SlingFile.com will be subjected to immediate termination. Additionally, replicate infringers will not be abided.

Adjustment of Standard Technical Procedures

It is SlingFile.com's policy to put up and not hinder with standard technical procedures it concludes are reasonable under the circumstances, (i.e. technical procedures that are used by copyright owners to identify or protect their copyrighted work(s)).

"Non-Compliant Communications" Policy

SlingFile.com can take any decision that seems suitable for handling non-compliant notices in whatever way seems to be reasonable given the events presented.

Submission of False Information

The submission of any sort of false information in a notification or counter-notification submitted to SlingFile.com annulled any claim of right made by the submitting party.
